Kenny Yap co-heads the International Trade practice group and is a member of the Maritime & Aviation and Insurance practice groups. Kenny is recommended for Shipping by The Asia Pacific Legal 500 (2004/2005).

Kenny's main area of practice is international trade and shipping covering both contentious as well as non-contentious work.

Insofar as contentious work is concerned, Kenny has acted on a wide variety of disputes, including customs and letters of credit disputes, cargo claims, bunker and repair claims, mortgage enforcement, charterparty disputes, maritime fraud claims, death and personal injury claims, shipping casualty matters, insurance and insolvency. Some of the notable contentious matters in which Kenny has been involved include:

 

acting for ship owners in several complex and high-value disputes, including claims arising from unauthorised shipping and chartering transactions, loss of cargo and recovery of proceeds;

acting for a multinational oil corporation in pursuing arbitration in Singapore for the breach of a contract for the supply and delivery of oil worth more than S$12 million;

acting for the Indonesian Air Force (TNI-AU) in relation to the seizure of one of its aircraft;

acting for Star Cruises in relation to a fire which occurred on board the vessel “SUPERSTAR GEMINI”;

acting for engine suppliers on a variety of disputes involving the supply and installation of marine engines including defending claims brought against the engine supplier as a result of alleged defects in the engines;

acting for a number of shipyards, both local and foreign, in pursuing as well as defending actions and arbitrations relating to the repair of ships; and

acting on a re-insurance arbitration between the Singapore Aviation and General Insurance Company and the British American Insurance Company.

 

As regards non-contentious work, Kenny's experience encompasses the following:

 

advising multinational corporations on the drafting of their standard terms and conditions for sale of goods;

advising suppliers on the sale and delivery of goods and equipment to shipyards in Singapore and overseas for installation on vessels and rigs;

advising on the sale, supply and delivery of generator sets for installation in power plants in Indonesia and India;

advising shipowners on the purchase of equipment for installation on vessels and FPSOs;

advising on a variety of transactions pertaining to the sale, purchase and transportation of coal, oil, palm oil, chemical and various other commodities; and

advising on contracts of affreightment, chartering contracts, leasing contracts, logistics contracts, shipbuilding contracts, repair and conversion contracts, warehousing contracts and freight forwarding contracts.

 

Kenny is a member of the Singapore Shipping Association’s Legal and Insurance Committee. He is also a fellow of the Singapore Institute of Arbitrators and a member of the Maritime Law Association of Singapore.

Kenny graduated from the University of Cambridge with a BA (Hons) degree in Law and an LLM. He qualified as a Barrister-at-Law at Middle Temple. He was called to the Singapore Bar in 1993, when he joined Allen & Gledhill. He became a partner in 2000.
