Daren Shiau is Head of Competition & Antitrust. Daren is a competition law specialist. His practice covers both antitrust hearings and appeals, and non-contentious competition and policy advice.

Daren is cited as the “most highly nominated practitioner” and “a real expert, according to rivals” in the Competition chapter of Who’s Who Legal: Singapore (2008). He is further recommended as a leading antitrust practitioner in The International Who’s Who of Competition Lawyers (2006 to 2010) and the Euromoney Guide to the World’s Leading Competition and Antitrust Lawyers (2006 to 2010).

In 2012, Daren was identified as one of the world’s most talented competition lawyers in Global Competition Review’s Forty Under 40 list, following an international survey. The list is conducted once every five years, and he remains the only Southeast Asian lawyer ever named.

Since the merger control regime of the Competition Commission of Singapore (CCS) came into force in July 2007, Daren has advised on 20 of the 29 merger filings lodged with the CCS.

Daren has also been represented parties in more than 50% of the CCS’ public decisions. His deal book of groundbreaking competition cases undertaken with the Practice, which is described by Chambers Global and Chambers Asia (2010) as “market-leading”, covers both the CCS and sectoral regimes. These include:

 

successfully advising on Singapore’s first-ever share acquisition cleared under the merger control regime of the Competition Act (Chapter 50B): US$3.6 billion acquisition by Flextronics International Ltd of Solectron Corporation;

successfully advising on Singapore’s only four public take-overs of listed companies (Labroy/Dubai Drydocks, NCS/SCS, SATS/SFI, Glencore/Chemoil) to be cleared pursuant to the CCS’ merger regime and the Security Industry Council’s Practice Statement on Merger Procedures;

successfully overturning the only Provisional Statement of Decision to block a merger ever issued by the CCS;

successfully defending parties in abuse of dominant investigations commenced by the CCS in the overnight cruise, tobacco and sheet music industries;

successfully defending a monopoly gas transporter in the first competition dispute to be heard by a tribunal convened under the Gas Act (Chapter 116A), an essential facilities and access rights matter; and

leading in the establishment of Singapore antitrust regimes such as the merger control framework under the Airport Competition Code administered by the CAAS, and the redrafting of the country’s media competition framework, the Media Market Conduct Code, which regulates TV and print, to cover new media technologies.

Daren has been seconded to the London and Brussels offices of a Magic Circle firm’s EU Competition Practice where he worked on European Commission and Office of Fair Trading matters. He presently sits on the Competition Roundtable of the CCS.

Daren graduated in 1996 with an LLB (Hons) degree at the National University of Singapore where he was placed yearly on the Law Faculty’s Dean’s List and received the NUSSU Gold Award. He currently serves on the Board of Film Censors and is a District Councillor of the Central Singapore CDC.
