Tham Kok Leong is a Partner in Corporate & Commercial and is the Head of the Technology & Corporate Intellectual Property Practice Group.

Kok Leong’s practice area centres on technology and intellectual property transactions, agreements and advice. He has substantial experience in advising on, negotiating and drafting a wide range of commercial agreements related to IT, outsourcing, e-commerce, e-banking, telecommunications, contract manufacturing, technology transfer, research and development, merchandising, franchising, licensing, sports, media and publishing, sales and agency and distributorships.

Kok Leong graduated from the National University of Singapore with an LLB (Hons) degree. He was called to the Singapore Bar in 1994, when he joined Allen & Gledhill. In The Asia Pacific Legal 500 (2002/2003 and 2003/2004) , he is recommended for information technology. The Asia Pacific Legal 500 (2004/2005) noted that for information technology, Kok Leong is "prominent in a practice which advises on software development and licensing". The Asia Pacific Legal 500 (2005/2006) noted that Kok Leong was active in the area of outsourcing work, citing his work advising Singapore Airlines Limited on a S$300 million arrangement with IBM.

Significant transactions and the clients Kok Leong has represented include:

Singapore Airlines in its IT infrastructure outsourcing transaction with IBM worth S$300 million over seven years. Under the agreement, IBM will manage SIA’s data center, end-user computing support service and information technology help desk. The agreement also involved the transfer of affected SIA employees to IBM;

a Japanese manufacturer and distributor of data collection systems and labelling solutions in their its regional licensing agreement and application services agreement with Oracle, for the client’s group of companies spanning 10 countries;

a statutory board in tenders for and transactions relating to outsourcing of its primary data backroom processing and custodial functions;

a group of companies managing and operating several local hospitals in their software development and system integration matters with an Indian software vendor;

a joint venture set up by local banks to facilitate their admission into a foreign exchange clearing and settlement system, in their software and service agreements with an IT vendor for key systems, applications and maintenance services;

 

National/Government agency work

various statutory boards in tenders for and transactions relating to IT projects, including the Land Transport Authority in a nationwide project to implement a contactless electronic payment system for all transportation services and for other goods and services;

the Singapore Land Authority on a bulk tender exercise for a group of statutory boards and corporations in respect of data conversion services for government maps;

a statutory board in tenders for and transactions relating to outsourcing of its primary data backroom processing and custodial functions;

 

Electronic commerce/banking

a joint venture between a Singapore bank and a US company for the establishment of an on-line brokerage business for trading in securities and other financial instruments, especially in relation to the information technology and intellectual property issues that arose in the course of the transaction;

local and foreign securities brokerages in their e-trading agreements and internet initiatives;

two major multi-national US banks in their Internet hosting, electronic mall and other e-commerce projects;

 

Telecommunications

a major content provider in their co-operation agreement with a local mobile telecommunications company for billing of content over a shared billing system;

a major local telecommunications company in their telecommunications services agreement with a local mobile telecommunications service provider;

various service providers of internet access services on their customer agreements, resale agreements and access service agreements;

a major local telecommunications company in their migration agreement with a local mobile telecommunications company for the migration of customers from one network to another;

a Japanese MNC in a joint venture with a local party for the development of telecommunications devices; and

 

Distributorship & reseller agreements

Epson Singapore in the development of standard agreements for regional channel management, covering distributors, dealers and resellers for its wide range of imaging products.
