Yap Yin Soon is a member of the Maritime & Aviation and International Trade practice groups. He handles all aspects of marine, air and other carriage related disputes such as disputes arising from cargo loss, damage, contamination and short-landing, air waybills and bills of lading, marine casualties (including collisions, groundings, sinkings, pollution), charterparties, crew claims, ship construction, conversion/ modifications and repair, land carriage, container lease agreements, ship mortgage, sale of goods both domestic and international and marine and land transport insurance.

Notable matters in which Yin Soon has been involved include:

 

"ORAPIN GLOBAL" c/w "EVOIKOS" involved in both the civil and criminal proceedings arising from the collision;

"CENTURY DAWN"[1998] 1 SLR 775 a High Court case involving the issue of priorities in relation to a mortgagee's claim for insurance premiums paid and legal costs;

"PIONEER GLORY" and "POE-2410" [1998] SGHC 240, [2001] SGHC 156 and [2002] 1 SLR 265 a High Court and Court of Appeal case involving issues relating to a claim for wrongful detention by a tug and barge owner of cargo and quantification of damages;

"THE ENDURANCE I" [1999] 1 SLR 661 a Court of Appeal case involving issues relating to breaches of charterparty, the principles applicable to damages and Offers to Settle made pursuant to Order 22A of the Rules of Court;

"Philips Hong Kong Limited v. China Airlines Limited" [2002] 1 SLR 57 and [2002] 3 SLR 367 a High Court and Court of Appeal case involving the construction of Articles 22 (2) (a) and (b) of the Warsaw (Hague) Convention being the limitation provisions applicable in a case of damage to cargo carried by air;

Maintop Shipping Company Limited v. Bulkindo Lines Pte Limited (The "Marinicki") [2003] 2 LLR 655 involving an unsafe port claim;

P.T. Putrabali Adyamulia v. Societe Est Epices v. Enrico Webb James Snc (The "Intan 6 V.360A SN") [2003] 2 LLR 700 involving a commercial dispute between buyer and seller in relation to goods lost whilst in transit;

Trans-World (Aluminium) Ltd v Cornelder China (Singapore) [2003] 3 SLR 501 involving claims relating to cargo stored in China;

Paquito L. Buton v The Owners of the ship or vessel "Rainbow Joy" [2005] 1 SLR 589 a High Court decision subsequently affirmed on appeal by the Court of Appeal involving the validity of a crew member's employment of contract based on the POEA form and terms and conditions and conflict of laws issues.

Front Carriers Ltd v Atlantic & Orient Shipping Corp [2006] 3 SLR 854 a landmark case in the Singapore arbitration sphere involving the issue of whether the International Arbitration Act granted jurisdiction to the Singapore Court to grant an injunction in aid of a foreign arbitration; and

The "Emma Maersk" [2006] SGHC 180 a High Court decision which was subsequently affirmed by the Court of Appeal on appeal involving the consideration of the common law duties and responsibilities of a vessel to ensure the safety of a harbour pilot while on board and the applicable regulations thereto and whether the vessel had committed a breach.

 

In The Asia Pacific Legal 500 (2002/2003), Yin Soon has been cited as a "noteworthy practitioner".

Yin Soon graduated from the University of Exeter with an LLB (Hons) degree, upper second class, in 1991. He obtained an LLM in International Business Law from King's College, London University in 1992. He qualified as a Barrister-at-Law at Middle Temple in 1993 and was called to the Singapore Bar in 1994 when he joined Allen & Gledhill. He was made a partner in 2000.
