The Myanmar Directorate of Investment and Company Administration has issued guidelines explaining how company names are assessed under sections 25 to 27 of the Myanmar Companies Law 2017.

The guidelines focus on ensuring that proposed company names do not conflict with existing registered names or create confusion in the market. In particular, names that are identical or too similar to existing companies may be rejected, including where similarity arises from word order, minor spelling variations, or phonetic resemblance.

The guidelines also highlight that names may be considered problematic where they could mislead the public into believing there is an association with existing businesses, or where they imply affiliation with government bodies or international organisations.

Examples provided in the guidance illustrate that even small variations in spelling or structure may not be sufficient to distinguish a proposed name from an existing registered name. The registrar retains discretion to require changes where a proposed name is considered inappropriate under the Companies Law framework.
