The Myanmar government recently issued Guidance on Execution of Contracts (“Guidance”) which instructs government departments and agencies to consider certain criteria prior to the execution of a contract. The Guidance provides, for example, that government departments and agencies must conduct a feasibility study before executing a contract or ensure that the project under consideration has a positive impact for Myanmar. Such studies are to be re-evaluated by experts. The Guidance also provides that government agencies should terminate contracts where the private sector party is not complying with its obligations and should include early termination provisions in the contract.
